No Fault Divorce Corruption: National Association of Women Lawyers (NAWL)

 The National Association of Women Lawyers (NAWL) is an organization focused on advocating for the progress and advancement of women in the legal profession and justice system. However, the organization has also been associated with problems related to no fault divorce. This paper examines the problems associated with no fault divorce, the role of the National Association of Women Lawyers in promoting these laws, and their impact on families and children. 


No fault divorce has led to several problems that cannot be ignored. One such problem is the impact on the emotional and physical well-being of children. Research shows that children of divorced parents are at higher risk of experiencing developmental problems such as depression, anxiety, and diminished academic performance. No fault divorce laws usually lead to a lengthy and expensive legal process, which consumes household resources that would otherwise be available to the children. It is apparent that children are the most significant casualties of what is perceived as a quick fix in ending unhappy marriages.


Another problem associated with no fault divorce is the difficulties that arise when a marriage breaks down, particularly with regards to joint family finances. One parent may receive a more favorable distribution of assets and income, and the other parent may be left in financial disarray, which usually leads to conflicts. This issue usually leaves children caught in the middle between warring parents and living in unstable conditions, leading to dysfunctional relationships in the future.


The National Association of Women Lawyers, while well-intentioned to advance women's rights, has contributed to the increase in broken marriages because of their advocacy for no fault divorce laws. This advocacy contributes to the normalization of divorce and has helped to encourage marital dissolution through the use of no fault divorce. This is concerning because divorce cases generate a considerable revenue to lawmakers, judges, and law firms, leading to the possibility of collusion among the different institutions. 


It is distressing that the National Association of Women Lawyers and the legal system, in general, continue to promote this system, despite its destructive impact on families and children. Moreover, it is clear that most legal firms are business-oriented, and the continued promotion of no fault divorce laws has made this procedure a business proposition, with different groups of individuals profiting from increased divorce rates. Law firms have commoditized an area of law that should, ideally, be considered sensitive, with the result being the dissolution of marriages, and the emotional strain it can cause.


The idea of no fault divorce is also immoral from a religious perspective. Most religions view marriage as a sacred bond, and breaking it is seen as an ultimate devolution on the sacred vows of the couple. This viewpoint aligns with the teachings of the Church where divorce is viewed as a mortal sin that should be avoided at all costs. From the Church's perspective, divorce is, therefore, morally wrong. 


In conclusion, no fault divorce laws have caused multiple problems, including emotional distress and financial difficulties on parents and children. These problems cannot be denied, and they cannot simply be seen as a quick fix to unhappy marriages. The National Association of Women Lawyers has contributed to the persistent promotion of no fault divorce laws, a factor that has led to the current problems associated with it. Additionally, it is immoral, or at least seen as such by the church, to consider divorce under any circumstances. It is hoped that the legal system and organizations promoting the procedure take into consideration the impact that these laws have on families and children and start to advocate for more amicable ways of resolving marital disputes.
